Planning & Inspections Department

1. What can you do about my neighbor not mowing his yard?

We have no county ordinances that can make a person mow his yard, nor do we have any ordinances that can make a person sew grass in his yard.

2. Our deed restrictions do not allow a Manufactured Double-wide in our subdivision; can you deny his permit application?

If the zoning district allows a double-wide, we can not deny a application for a building permit. Our department does not enforce deed restrictions, this becomes a civil matter.

3. Why can’t I live in my RV while I’m building my new house?

The Lincoln County Unified Development Ordinance doesn’t allow this.

4. Why can’t I use my old mobile home as a storage building?

The Lincoln County Unified Development Ordinance doesn’t allow this.

5. Will you do something about the abandoned structure next door?

Lincoln County doesn’t have any ordinances that address this problem.

6. Now that I’ve told you about my problem, why do I have to complete and sign a complaint form?

A completed and signed complaint form is very advantageous if a case ever needs to go to court.

7. If I submit a complaint form, do you have to tell them who made the complaint?

Complaint forms are public record; therefore, if the person comes into our office and requests to see the form, we must show them.

8. I have one home on my property. Can I put another one there?

The Unified Development Ordinance generally allows only one home per lot, so your property would have to be subdivided, the create two lots. The question then becomes whether you can meet the minimum lot size requirements and other rules governing the subdivision of property.

9. Can I have an office or a beauty parlor in my home?

“Customary home occupations” are permitted. Among the stipulations: The home occupation must be clearly incidental and subordinate to the residential use of the dwelling and use of the dwelling for the home occupation is limited to a maximum of 25% of the gross floor area.

10. How do I go about getting my property rezoned?

The first step is to talk with a zoning administrator, who will advise you on the matter.

Next, you must fill out an application and pay a fee.

Rezoning requests are typically heard by the Board of County Commissioners on the first Monday of the month. Applications must be submitted at least 45 days in advance of the hearing.

11. Can an older mobile home be moved into Lincoln County from another county?

To be moved into Lincoln County, a mobile home must have been constructed after July 1, 1976.

If it’s going onto an individual lot, it must have a shingled roof and vinyl siding (or other siding commonly used in standard residential construction).

If it’s going into a mobile home park, it may have a metal roof and metal siding.

12. Can I replace a mobile home with another mobile home in a zoning district that doesn’t allow mobile homes?

The zoning ordinance allows for the replacement of a nonconforming mobile home as long as the replacement mobile home is the same class or higher, is a newer model than the older one, and is placed on the lot within 180 days of the removal of the old one.

13. Do I need a building permit for a storage building, to enclose my carport, or to put a roof over an existing deck / porch?

Yes, any structure that measures 12 feet or greater in any dimension requires a building permit per the International Building Code.

14. Where can I get a Code book?

You can order them from the Department of Insurance; our office has the order forms. You may be able to purchase the Code books from your local Community College bookstore.

15. When are you going to get to my jobsite?

If you have called in your inspection request the previous workday, prior to 2:00 pm, the inspector should be at your jobsite between the hours of 8:00 am and 2:30 pm.

16. When can I get electrical service?

1. After your final has been approved and a sticker has been placed on the meter-box
2. After you have paid a deposit for temporary electrical (which is 2.5 times the building permit fee, for residential) and the inspection has been approved and a sticker has been places on the meter

The income limits vary depending on household size and ages of household members and the program you are applying for.

Soil and Water

1. What’s required to build a pond?

The Soil & Water Conservation District has no authority over ponds. We offer information on construction, permits required and pond management. Contact the Army Corps of Engineers and the Division of Water Quality for permits required.

2. How do I get my soil tested?

For agronomic information (lawns, gardens, pastures, etc): Soil test information (boxes & information sheets) are provided by our office. The soil sample is sent to Raleigh to be an analyzed. Soil testing is a free service. For septic system perking test: This service is provided by the Environmental Health Department.

3. Can someone reduce the flow of water in a stream?

The County has no ordinance regulating that. You must contact the Division of Water Quality in Mooresville. Lincoln County does have a Buffer Ordinance that is administered under the Building & Land Development.

4. Can my neighbor let their surface water come onto my property?

Neither the County nor the State has enforcement for drainage issues. This issue must be taken up through civil actions.

5. Should a construction site maintain sediment on the property?

Yes, the County has a Sedimentation & Erosion Control Ordinance. This ordinance addresses issues pertaining to keeping sediment on the property as well as out of the waterways in the county.

6. Do I have to have an erosion control plan for building my house?

Any land disturbance over one acre must have an approved erosion control plan. If the disturbance is less than one acre but greater than 1000 square feet requiring a building permit, a Single Lot Disturbance Form must be completed.
